Terms for Selling to Us

1. About these terms

These Terms for Selling to Us apply whenever you offer to sell a watch, item of jewellery, precious metal, diamond, gemstone or other luxury item (“Item”) to London Gold Luxuries Ltd (“London Gold”, “we”, “us” or “our”).

They apply whether you are selling an Item outright or offering it as part exchange against an item purchased from us.

By submitting an Item for valuation or sale, you confirm that you have read and accepted these terms.

2. Valuations

You may request an initial valuation through our website, by email, telephone or in person.

Any valuation provided using photographs, descriptions or other information supplied remotely is an indicative estimate only. It does not constitute a binding offer to purchase the Item. A final purchase price will only be determined after we have had the opportunity to inspect and, where appropriate, authenticate the Item.

Our valuation may take into consideration the Item’s:

  • brand and model;
  • reference and serial number;
  • age;
  • condition;
  • originality;
  • box, papers and accessories;
  • service history;
  • replacement or aftermarket components;
  • authenticity;
  • current market conditions;
  • demand; and
  • likely resale value.

We are not required to make an offer for any Item.

3. Our offer

Where we decide to purchase an Item, we will communicate our offer to you.

Unless we expressly state otherwise, an offer is subject to the Item being in substantially the same condition as represented to us and successfully passing our inspection and authentication process.

Unless a different period is specified when the offer is made, an offer will remain open for 7 days.

We may withdraw or revise an offer if information subsequently comes to light which materially affects the value, authenticity, ownership or condition of the Item.

4. Your responsibility when selling to us

When you offer an Item for sale, you confirm that:

  1. you own the Item or have full authority from its owner to sell it;
  2. you are aged 18 or over;
  3. the Item is not subject to outstanding finance;
  4. there is no charge, lien or other security interest over the Item;
  5. the Item has not been stolen or unlawfully obtained;
  6. you are not aware of any unresolved police, insurance or ownership claim relating to the Item;
  7. the Item is genuine;
  8. the information you provide to us is accurate;
  9. you have told us about any known damage, repairs, modifications, replacement parts, polishing or servicing;
  10. you have disclosed anything else you reasonably know which could materially affect the value or authenticity of the Item; and
  11. you are legally entitled to complete the sale.

These confirmations apply each time you submit an Item to us.

5. Identification and ownership checks

We may need to verify your identity before completing a transaction.

Depending on the circumstances and the value or nature of the Item, we may ask you to provide:

  • photographic identification;
  • proof of address;
  • proof of ownership;
  • purchase documentation;
  • warranty documentation;
  • service records;
  • insurance information; or
  • other information reasonably required for our compliance checks.

We may decline to proceed if we cannot satisfactorily establish your identity, ownership of the Item or the legitimacy of the transaction. Where we are legally required to retain identification or transaction information, we will retain it for the applicable period.

6. Inspection and authentication

Every Item is subject to our inspection and authentication process before a purchase is completed. We may inspect the Item ourselves or use appropriately qualified specialists or third-party services where we consider this necessary.

Our assessment may include examination of:

  • movement;
  • case;
  • dial;
  • hands;
  • bracelet or strap;
  • clasp;
  • serial numbers;
  • reference numbers;
  • hallmarks;
  • gemstones;
  • engravings;
  • documentation; and
  • other identifying features.

If an Item is counterfeit, materially different from the description provided, contains undisclosed replacement or aftermarket components, or otherwise fails our requirements, we may withdraw or revise our offer. Any servicing, repair or restoration that we believe will be required may also affect the offer.

7. Counterfeit or potentially stolen Items

If we have reasonable grounds to believe an Item may be counterfeit, stolen, fraudulently obtained or subject to a third-party ownership claim, we may take appropriate steps to protect ourselves and others.

This may include retaining the Item where legally permitted or required, contacting relevant authorities, checking recognised databases and providing information to the police, insurers or other appropriate organisations.

Where an Item is retained by a competent authority, our ability to return it may be outside our control.

If money has already been paid to you and it subsequently becomes established that you did not have the right to sell the Item, we reserve the right to seek recovery of the amount paid and any reasonable associated losses.

8. Payment

Payment for an accepted Item will be made by a method agreed with you at the time, which may include bank transfer or cash.

Where payment is made by bank transfer, it will ordinarily be made to an account held in the seller’s own name, and we may request evidence that the receiving account belongs to you.

Where payment is made in cash, additional identification and record-keeping requirements may apply, and we will explain these to you before the transaction is completed.

Payment may be delayed where additional identity, ownership, authenticity, fraud or compliance checks are reasonably required.

9. Completion and transfer of ownership

The sale is completed once:

  • our final offer has been communicated;
  • you have accepted the offer;
  • the Item has passed our required checks;
  • any required identification and ownership checks have been completed; and
  • payment has been made or otherwise confirmed as agreed.

Ownership of the Item transfers to London Gold upon completion of the transaction.

10. Sending an Item to us

If you send an Item to us rather than bringing it to our premises, you are responsible for ensuring that it is properly packaged and appropriately insured until we have received it.

We recommend using a reputable, trackable delivery service with insurance suitable for the full value of the Item. Risk remains with you until the Item has been received by London Gold.

We will confirm receipt once the Item has arrived and has been logged into our system.

11. If you decide not to accept our offer

If we have received your Item and you decide not to proceed with the sale, you may request its return. Subject to any separate arrangement agreed with you, we will arrange for the Item to be returned using an appropriate trackable and insured service.

Where we have agreed to receive an Item solely for valuation and you do not proceed with a sale, the Item remains yours.

12. Withdrawal before completion

You may withdraw an Item from consideration at any time before the sale has been completed and ownership has transferred to London Gold.

Once the transaction has completed, the sale cannot ordinarily be cancelled simply because you have changed your mind. This does not affect any rights that may arise under applicable law.

13. Part exchange

Where we agree to accept an Item in part exchange:

  • these Terms for Selling to Us apply to the Item you provide;
  • our Terms of Sale apply to the item you purchase; and
  • the agreed part-exchange value forms part of the overall transaction.

Any part-exchange valuation is subject to our inspection and authentication unless we expressly confirm otherwise in writing.

If an Item subsequently proves to be counterfeit, stolen, subject to finance or otherwise not capable of being lawfully sold by you, we may reverse the relevant part-exchange arrangement and seek recovery of any resulting loss.

14. Breach of your warranties

If information you have provided to us proves to be materially false or misleading, or if you were not entitled to sell the Item, we may, where legally permitted:

  • cancel an uncompleted transaction;
  • withdraw our offer;
  • seek repayment of money already paid;
  • retain the Item where lawful or required;
  • notify the appropriate authorities; and
  • seek recovery of reasonable losses and costs resulting from the breach.

15. Liability

Nothing in these terms excludes or restricts liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, London Gold will not be responsible for indirect or consequential losses arising from a proposed or completed transaction. Nothing in these terms removes any rights which you have under applicable law.

We will review your complaint and aim to respond as promptly as reasonably possible.

17. Privacy

Information collected during the valuation or purchasing process is handled in accordance with our Privacy Policy.

This may include contact information, identification information, photographs, Item details and transaction records.

18. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction over disputes arising in connection with these terms, subject to any mandatory rights available to you under applicable law.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to apply. Our failure to enforce a provision immediately does not prevent us from enforcing it later.
